After the NC Appeals Court ruled that Michael Peterson's appeal was denied, his attorney, Maher, told news media that "the ruling frustrates him" and that he would appeal to the State Supreme Court. However, he did not reveal a time schedule for doing so.

On November 12, 2008, J. Burkhardt Beale and Jason Anthony, Richmond, Va. attorney's, who now represent Michael Peterson, filed a motion for a new trial in Durham County court on three grounds: that the prosecution withheld exculpatory evidence about a tire iron; that the prosecution used an expert witness, whose qualifications are disputed; and that one juror based his judgment on racial factors not evidence.

On December 3, 2008 a press release was released from the Durham Superior Court stating that the Honorable Orlando Hudson has determined than an evidentiary hearing is necessary to resolve factual disputes in the case. A pre-trial conference is expected to be scheduled for January, 2009 to limit the scope of the hearing
